Bushy Park?
Right direction, but rather too hilly for Bushy Park. I think it might be as far away as the North Downs Way, somewhere around Newlands Corner.
North Downs Way? Maybe nearish to Godstone?
Bushey Park is flat and low and in London! The clue is 40 miles from London. My guess is maybe near the Devils Punchbowl and Gibbets Hill.
Looks similar to the view of the city from the Hogsback near Guildford.
Farthing Downs ?
I reckon the pic is taken from the north with the Shard on the right, the City on the left and Canary Wharf in the middle.

As to exactly where the pic is from my guess is to the north of DG's old Watford manor.

There's a clue in the description. Where are the crossword puzzlers with knowledge of Herts/Beds?
A proper analysis would study which buildings are obscuring which others, just to rule out the possibility of the picture being taken from the south, but then displayed with left-right reversal.
Waterloo may also be a clue, trains to the South and West. I still think around Devils Punch bowl or else Guildford.
The white-roofed building just to the right of centre looks like the Sky Garden (Walkie Talkie) on Fenchurch Street, seem from the South West. 40 miles south-west of London takes you toGibbet Hill on Hindhead Common, the second highest point in Surrey, looking at London through the gap in the North Downs at Guildford formed by the River Wey.
Just realised that Battersea Power Station is on the left.

So a bit further south than I initially thought.
Leith Hill?
Checking angles and distances, Black Down in West Sussex fits rather well.
W H Davies lived in Kent for a while. He wrote 'Leisure' which starts with

But maybe a red herring.
40 miles? Wow!!!!
Most of the time I have a hard enough seeing the City from just 10 miles away!!
